Kay's Story:

Like I have heard so many people say in this situation, "I would never wish this on my worst enemy". I totally agree. This is the most horrible, life destroying situation anyone can be in.

I can't use any names. The case is still going on. But here's what has happened. On May 29, 2008, we got a knock on our door from some child advocacy group. Not even the police. The child advocacy group says that there has been an allegation against my husband for raping his cousin almost eight years ago

I guess my husband was a convenient target. Everyone knew they stayed at our house. By the way, she went to the police around the end of February, 2008, and we didn't hear anything until the end of May.

At the time the alleged rape occurred, she was two months from being seventeen, and my husband was 26. My husband's grandmother had a sudden heart attack and was in the hospital. His cousin and her mother came in from out of town, and we allowed them to stay the night at our house.

I am not sure where I am supposed to be, but she never mentions me in her police report. Well, sort of. All she said was "him and his wife were swingers and into weird sexual practices", but it never says where I was during this alleged attack.

I have never in my life been a swinger, nor will I ever be. Also, where was her mother? They were both at our house at the time. It took forever for us to get a copy of her statement, which she did not write at the police station. This report was twelve pages long and written out like a fantasy novel.

I thought it was protocol to write police statement at the police station. I didn't think you could take "paperwork" home to complete and send in a month later.

I guess we thought this would go away. Silly us. The police were 'nice enough' to contact my husband on July 15th to let him know they had issued a warrant for his arrest. Of course he did the right thing; he turned himself in.

We had already met with a bail bondsmen to work on getting him out as soon as we paid them 10% of his bail. Our part was $2500. Thank goodness we had a savings account.

They told us that since we had all of this taken care of, he should only have to be in jail for about four hours. He ended up being in there for almost ten. I know it could have been worse. He could still be in jail. But when your are not a person who is ever in any type of trouble, ten hours can seem like forever.

Of course, when you're accused of such a heinous crime, the police already assume you are guilty; they took over four hours just to book him, and then three hours later they told him his fingerprints were taken incorrectly and were smudged. They redid the fingerprints and he was finally released.

He had to appear in court on August 15th just to let the judge know he had secured an attorney. We have not been back to court since then; the courts keep postponing it and the courts won't make an exception for anyone.

It has now been four months since he has seen or talked to our 12 year old son. He also has to meet with a probation officer once a week and pay a fine each time he visits. One of the stipulations that the judge put my husband on is that he can't see his son, not even supervised. This is the worst. My husband and our son are so close. My husband has coached our son's baseball team since our son was three years old.

I am sure this is because his cousin said in her statement that my husband has custody of our son and she feared for his safety. Where am I and why did it take her almost eight years for her to be concerned for our child's safety? My husband and I have been together for almost 17 years. We were high school sweethearts. We are now approaching Christmas and I am afraid my husband won't get to be with us.

The whole family knows she is lying. Her mother and her both have serious mental issues and when the mom gets mad at the family she lashes out like this. She even claims that her brothers raped her when they were growing up. They all say when they were growing up she made up stories about guys raping her or beating her and they would beat them up.

They now know that it was all lies just to get attention. Thankfully, I have a supportive family, and they know my husband didn't do this. I know he didn't do this. This is not even something he is capable of. The guilt would have already killed him.

My mom has allowed my husband to stay at her house. On Saturday nights, she keeps our son so my husband and I can spend time together. We are now $30,000 in debt because of attorney fees and bail. If we have to go to trial, we will be out another $25,000. I am sure we will end up having to sell our house and move our son away from the friends he has known all his life.

This has changed our life dramatically, and I am afraid that if my husband is found guilty, he will commit suicide. Where we are, if you are convicted of a sex crime involving anyone under 17, you have to register as a sex offender. Your picture and address are run in the newspaper and any one can search the database before moving into a neighborhood to see if there are any offenders in the area.

My husband could not live with that or let our son go through school with a father that has been branded a rapist. Not only has this girl and her mother destroyed our lives right now, they may have possibly already destroy our lives forever by taking away my best friend and the father of our son. All I can say is, what goes around comes around....karma's a bitch. I will let you know the outcome when all of this is over.....good or bad.
